MODEL OF GRADUATING STUDENT

Upon completion of this program, undergraduates are expected to be able to:
ON 1 Тo form and justify the reasons that slow down the process of formation of the rule of law in the Republic of Kazakhstan, to organize scientific research using the provisions of the rule of law, to demonstrate readiness for fruitful research and teaching activities;
ON 2 Тo demonstrate the knowledge gained in the study of the features of the historical formation of statehood and the formation of the legal culture of the CIS and European countries, to justify the materials of legal and other social practices, to analyze the specific political and legal doctrines of Kazakhstan and Europe, the philosophical problems of the origin and historical evolution of science, as well as the main legal systems of our time;
ON 3 Apply the norms of national and international law in the field of commercial and corporate law in resolving disputes that exist in various legal orders, formulate and solve problems that arise in the course of practical and research activities using modern methods and technologies of legal analysis;
ON 4 Тo design the development and improvement of the current civil and civil procedure legislation;
ON 5 Тo evaluate the results of comparative legal analysis in the research of international legal and European legal institutions and phenomena and to develop ways to improve the theory and practice of law, psychological and pedagogical education of participants of educational relations, legal culture, public administration and public service of Kazakhstan in the CIS and Europe;
ON 6 Critically assess the state policy in the field of regulation of civil law relations, entrepreneurial activity, in the field of civil law; evaluate situations of law enforcement practice of exercising and protecting property rights and develop various solutions;
ON 7 Systematically understand and evaluate the global trends and dynamics of international economic relations, their theoretical and practical problems;
ON 8. Understand the mechanisms and factors of development of contract and commercial law in Germany and other European countries;
ON 9 Systemically understand the main directions of improvement of the constitutional and administrative legislation of Germany and Europe;
ON 10 Тo interpret and rank the stages of international economic integration, to determine the parameters of the influence of legal regulation on this process;
ON 11 Identify promising directions for the development of legal regulation of economic relations of Kazakhstan with foreign countries in order to integrate Kazakhstan into the international community;
ON 12 Тo contribute to the legal science through original research of the main conceptual provisions of comparative international law.

Course forms scientific-methodological competence of independent study of problems of law of obligations, their use in activities in scientific-pedagogical, practical jurisprudence. Discipline studies problems of defining concept, content, types, reasons for occurrence, termination of obligations, changes of persons.

Corporate governance and corporate legislation

  • Description - The modern concept of corporate governance, its structure and key components according recommendations of good practice of corporate governance as well as in the comparative law research context shall be learned in this course. Trends of developments of international standards of corporate governance and ways of their recognition by national legal systems, as well as approaches to formation of an institutional environment for an appropriate practice at a country level shall be discussed.

The course is based on the international standardized provisions of the CISG and the Rome Regulations of the EU.
